​These general terms and conditions of sale apply to all services provided on the Love Bordeaux website.

The customer declares that they have read and accepted the general terms and conditions of sale before placing their order. Confirmation of their order therefore constitutes acceptance of the general terms and conditions of sale.

Customers declare that they are of legal age and fully capable of entering into contracts.

 

3. Booking a tour

 

​When booking online, the customer must complete a form. They are required to check the accuracy of the information provided before confirming the booking. Love Bordeaux cannot be held responsible for any data entry errors.

 

The contract between the Customer and Love Bordeaux is effective upon receipt by the customer of a payment confirmation email sent by Love Bordeaux via its Stripe booking platform.

 

4. Prices of services sold on the website

 

The sale prices of services on the website are indicated in euros, including all taxes.

 

Sale prices may be modified by Love Bordeaux at any time, and the customer will be notified of any changes prior to making a booking.

 

5. Characteristics – Compliance

 

In accordance with Article L. 111-1 of the French Consumer Code, the customer may, prior to making a booking, consult the Love Bordeaux website to find out the essential characteristics of the services and/or products they wish to book. The products tasted during the culinary tasting are not detailed on the website at the time of booking. The Customer acknowledges that they have read and fully accept the characteristics of this service.

 

Information about Love Bordeaux's partners is provided for information purposes only and is not contractually binding. Love Bordeaux reserves the right to modify the list of partners encountered during events following the visit at any time and without notice. Product photos and descriptions are also provided for information purposes only and are not binding on Love Bordeaux.

 

Love Bordeaux will endeavour to accurately describe the experience offered on its website. However, given the digital presentation of products or services on the Internet, it is possible that the Customer's perception of the photographic representation of the products or services may not exactly correspond to the product or service itself, which the customer acknowledges.

6. Availability

 

​The services offered by Love Bordeaux are valid as long as they are advertised on the website and subject to availability (minimum number of customers per tour indicated on the website).

 

Love Bordeaux undertakes to respect the minimum and maximum number of participants indicated for each service.

 

7. Reservations

 

7.1 Online reservations

 

When the customer confirms their reservation by clicking on the ‘Confirm’ icon, they are deemed to have knowingly accepted the content and conditions of the reservation in question, including these General Terms and Conditions of Sale, the prices and the number of seats reserved.

 

Love Bordeaux will then confirm this booking by sending an email to the Customer.

 

Love Bordeaux reserves the right to suspend or cancel any booking, regardless of its nature and stage of completion, in the event of non-payment or partial payment of any amount owed by the customer, in the event of a payment incident, or in the event of fraud or attempted fraud relating to the use of the Love Bordeaux website, including in connection with previous bookings.

 

Love Bordeaux cannot be held liable in the event of an error in entering the customer's email address. The sale shall be considered final, unless the booking is cancelled by Love Bordeaux, in particular due to the unavailability of services. The customer may nevertheless exercise their right of withdrawal under the conditions set out in Article 9 of these General Terms and Conditions of Sale.

 

7.2 ‘Personalised request’ booking

 

The booking of a personalised service is only firm and final after written agreement and signature by the Customer (by email) and after immediate payment of an initial deposit of 30% of the total amount indicated on the quote. The remaining 70% must be paid no later than 10 days before the date of the service.

 

7.3 Payments

 

All bookings are payable in euros. Payment for services must be made:

- by credit card for online bookings

 

In order to optimise the security of banking transactions, the Love Bordeaux website has set up a secure online payment system with the Stripe payment platform so that the information provided remains protected during the payment process.

 

The Customer guarantees Love Bordeaux that they are fully authorised to use the payment card to pay for their booking and that these means of payment legally give access to sufficient funds to cover all costs resulting from their booking on the Love Bordeaux website.

 

Love Bordeaux cannot be held responsible for any fraudulent use of the means of payment used.

 

In the event of a payment incident, Love Bordeaux reserves the right to suspend or cancel any booking.

 

The Love Bordeaux website (lovebordeaux.com) is the only site authorised to sell its services. Love Bordeaux cannot be held liable for any bookings made on other websites. It is the Customer's responsibility to save and print the proof of payment if they wish to keep the bank details relating to the transaction.

 

8. Cancellation and modification conditions

 

Reservations are binding and full payment is required.

 

No refunds or right of withdrawal will be granted. Article L.121-21-812° of the French Consumer Code stipulates that the right of withdrawal cannot be exercised for contracts relating to leisure activities to be provided on a specific date or during a specific period. The organiser will not refund participants who do not show up on the day of the activity.

 

The service is guaranteed for a minimum of 11 people for the gourmet stop on the barge and 8 people in the speakeasy.

 

If this minimum is not reached, Love Bordeaux reserves the right not to organise the visit or to postpone it to a later date.

 

Customers may cancel all or part of their booking under the following conditions:

 

All cancellations must be notified by email, and the date of receipt of the cancellation will determine the cancellation fees indicated below.

 

- For cancellations made more than 3 calendar days before the scheduled date, no penalty will be applied.

 

- For any cancellation between 3 days and 24 hours before the scheduled date, a penalty representing 30% of the price including VAT of the service is payable by the customer, regardless of the amount of the service.

 

- For any cancellation made less than 24 hours before the date of the service, or if the customer does not show up on the day, the customer will be liable for a penalty representing 100% of the price of the service, including VAT.

9. Changes granted to the customer.

 

Any changes to the booking made by the customer after confirmation are subject to acceptance by Love Bordeaux.

9.1 Changes granted to the organiser:

 

In the event of exceptional unavailability, Love Bordeaux reserves the right to cancel the services. Participants will be informed by email or telephone.

 

Any cancellation by Love Bordeaux will result in a full refund of the sums paid by the customer.

 

Love Bordeaux reserves the right to terminate a service if, due to the behaviour of a customer, the rules of decorum and safety are not respected.

 

If weather conditions (heatwave, extreme heat, storm, hail, etc.) prevent us from holding the event in safe conditions, the service will be postponed or cancelled by the organiser.

 

In the event of the tour guide falling ill unexpectedly, Love Bordeaux may cancel the service and customers will receive a full refund.

 

Love Bordeaux may need to change the departure time and location for various logistical reasons. Participants will be notified by email as soon as possible, no later than two hours before the start of the tour.

 

In the event of restrictions imposed by local and/or government authorities due to a health situation, Love Bordeaux will be obliged to cancel the tour and customers will receive a full refund of their booking.

  

10. Intellectual property rights

 

All elements reproduced on the website, including texts, comments, works, illustrations, images and trademarks, are protected by intellectual property law. Any total or partial reproduction of the elements visible on the website is strictly prohibited.

 

11. Signature and proof

 

Love Bordeaux ensures the protection of its customers' personal information, but the customer is also responsible for protecting their personal data.

 

The customer must ensure the security of their online transactions, for example by not sharing their login details (e-mail address) with anyone. Love Bordeaux Tour cannot be held responsible for the disclosure of information concerning the customer to any person who has used their login details (email address).

 

In this regard, the use of the customer's login details (customer's email address) will be considered proof of identity and will result in the payment of the corresponding sums as soon as the booking is confirmed. Love Bordeaux cannot be held responsible for the fraudulent use of this information.

 

The provision of the credit card number and the final confirmation of the booking shall constitute proof of acceptance of the said booking.

 

The computerised records stored in the computer systems of Love Bordeaux and its partners shall be considered as proof of communications, bookings and payments between the parties.

13. Responsibilities

 

13.1 The organiser

 

Love Bordeaux offers a product discovery service, but is not the manufacturer of the products. Consequently, Love Bordeaux cannot be held liable for any physical injury and/or material damage that may result from the use of the products presented during the various services, which are distributed under the sole responsibility of their partners and consumed under the sole responsibility of the customer.

 

The customer must be of legal age to consume alcohol. Love Bordeaux may request identification at any time to verify the customer's age. Love Bordeaux may require alcohol to be consumed in moderation (alcohol abuse is dangerous for your health).

 

Any complaint concerning a product tasted or purchased must be addressed directly to the partner.

 

Any complaint made by a customer against Love Bordeaux must be made within 6 months of the event, stating the subject of the complaint.

 

13.2 Customer responsibilities

 

The customer undertakes to arrive at least 10 minutes before the departure time of the tour at the address indicated on the booking.

 

Transport costs to the tour departure point are the responsibility of the customer. The price includes the guided tour, tastings, drinks and private hire of the partner's premises.

 

The price does not include personal expenses or special requests.

 

Participants may decide to leave the tour at any time, but will not be entitled to any refund or reduction of any kind.

 

People with disabilities are invited to contact Love Bordeaux to check whether the services are suitable for their abilities.

 

In the event of a food allergy, the customer must inform Love Bordeaux at the time of booking.

 

In the event of damage during a service, Love Bordeaux reserves the right to claim compensation. The customer must take out civil liability insurance, which may be invoked in the event of damage.

 

14. Data protection

 

The information and data collected by Love Bordeaux during any booking made by the Customer are necessary for the management of bookings and commercial relations.

 

They may be transmitted to companies involved in these relations, such as those responsible for the execution of services and bookings, for their management, execution, booking, processing and payment. This information and data is also stored for security purposes, to comply with legal and regulatory obligations, and to enable Love Bordeaux to improve and personalise the services offered and the information sent.

 

The Customer may receive offers from Love Bordeaux.

 

Satisfaction questionnaires may be used for statistical studies carried out by Love Bordeaux with the aim of improving its service and that of Love Bordeaux's partners.

 

In accordance with current legislation on information technology, files and civil liberties, customers have the right to access and rectify their personal data. To exercise this right, they must write to stephanie.lovebordeaux@gmail.com or via the ‘Contact’ section, indicating their surname, first name and email address.

 

All persons participating in the services undertake, unless expressly requested in writing, to transfer their image rights.

 

Our website uses cookies. The data collected is intended for Love Bordeaux. It is necessary for the processing and management of customer bookings, as well as for commercial relations between Love Bordeaux and the customer.

18. Communication between the customer and Love Bordeaux

 

By using the website, the Customer agrees that communications between them and Love Bordeaux will mainly be conducted electronically (by email), except in specific cases set out in these Terms and Conditions or required by law.

 

Invoices will therefore be sent exclusively by email.

 

It is understood between the parties that the choice of method of communication constitutes an agreement on evidence within the meaning of Article 1316-2 of the Civil Code.
